The right to annual leave for employees in Cyprus is provided for by the Annual Holidays with Pay Law and the Organisation of Working Time Law.
If an employee had worked for a period less than 48 weeks within the year, the period of annual leave is reduced accordingly.
Absence from work due to an accident, sickness, maternity, parental leave or leave on grounds of force majeure, is considered as a working period.
Where payment for annual leave is made from the statutory holiday fund, the employee must take an uninterrupted period of at least nine days’ leave during the year.
The following days are not considered as annual leave days:
- public holidays provided by law, established practice or agreement;
- maternity leave, parental leave or leave on grounds of force majeure;
- days of incapacity for work due to an accident or sickness;
- days of strike or lock-out;
- any period of notice for termination of employment under the Termination of Employment Law.
An employee maybe entitled to longer annual leave if provided for by the agreement or custom.
