The provisions of the Termination of Employment Law (Law N.24/1967) were amended on the 25.07.2016.
The amendment relates to the notice given by employers to terminate the employment of workers absent due to incapacity.
Following the amendment to the law, if an employee is absent from work for a period of up to 12 months due to incapacity, an employer cannot dismiss the employee (cannot give notice of termination of employment) during a specific period of time. This period of time commences on the first day of the absence and ends on the last day of the absence with a period of time equal to one quarter of the total period of absence time added.
As a consequence of the amendment, the period of time whereby an employer is prohibited from giving notice of termination to employees which were absent from work due to incapacity has increased. The law previously prohibited employees giving such a notice for a period of up to 6 months from the first day of absence.
The amending legislation was passed following the media attention given to a case of an employee whose employment was terminated following absence from her work in order to receive treatment for cancer.
